2Licensed, not soldSe licencia, no se vende

While your subscription is active, we give you a personal, limited, non exclusive and non transferable license to use your form in your own business. You do not buy the software or its code. Every right these terms do not expressly give you is reserved.

Mientras tu suscripción esté activa, te damos una licencia personal, limitada, no exclusiva y no transferible para usar tu formulario en tu propio negocio. No compras el programa ni su código. Todo derecho que estos términos no te dan de forma expresa queda reservado.

3What is oursLo que es nuestro

The design, the screens, the look and feel, the texts, questions and clauses we wrote, the 1000 self love messages, the animations, the interactive face, the design studio, the panel, the code, the name Skin Consult and the Pro Hub Systems brand belong to Beauty By Estephany LLC and are protected by copyright and trademark laws.

El diseño, las pantallas, cómo se ve y cómo funciona, los textos, las preguntas y las cláusulas que escribimos, los 1000 mensajes de amor propio, las animaciones, el rostro interactivo, el estudio de diseño, el panel, el código, el nombre Skin Consult y la marca Pro Hub Systems pertenecen a Beauty By Estephany LLC y están protegidos por las leyes de derechos de autor y de marcas.

4What is yoursLo que es tuyo

Your logo, your photos, your texts, your services and your clients' information are yours. You give us permission to use them only to create, show and maintain your form. You confirm you have the right to use everything you upload.

Tu logo, tus fotos, tus textos, tus servicios y los datos de tus clientes son tuyos. Nos das permiso para usarlos solo para crear, mostrar y mantener tu formulario. Confirmas que tienes derecho a usar todo lo que subes.

5What is not allowedLo que no se permite

• Copying, recreating or imitating the design, the screens or the way Skin Consult works.
• Copying, downloading, modifying or reusing its code.
• Trying to get its source code or to get around its protections (reverse engineering), except where the law expressly allows it.
• Reselling, renting, sublicensing or sharing your form, your editor or your access with another business.
• Using Skin Consult or its screenshots as a model to build a similar or competing product.
• Removing or hiding the copyright notices.
• Using it for anything illegal.

• Copiar, recrear o imitar el diseño, las pantallas o el funcionamiento de Skin Consult.
• Copiar, descargar, modificar o reutilizar su código.
• Intentar obtener su código fuente o saltarse sus protecciones (ingeniería inversa), salvo donde la ley lo permita de forma expresa.
• Revender, alquilar, sublicenciar o compartir tu formulario, tu editor o tu acceso con otro negocio.
• Usar Skin Consult o sus capturas como modelo para crear un producto parecido o que compita.
• Quitar u ocultar los avisos de derechos de autor.
• Usarlo para algo ilegal.

6Free samplePrueba gratis

Skin Consult has no free trial period for your form. Before you buy, you can try the live demo and the sample design studio for free, with no card: in the sample you design the first 3 steps and watch your form live, but nothing is sent or published from there. Your form is built and published after you pay for your plan in Square.

Skin Consult no tiene un periodo de prueba gratis de tu formulario. Antes de comprar puedes probar gratis, sin tarjeta, la demo en vivo y el estudio de diseño de muestra: en la muestra diseñas los primeros 3 pasos y ves tu formulario en vivo, pero desde ahí no se envía ni se publica nada. Tu formulario se construye y se publica después de pagar tu plan en Square.

7Subscription and cancellationSuscripción y cancelación

• It is a subscription with Square, monthly or yearly: Pro $19.99 a month or $199 a year; Premium $29.99 a month or $299 a year. It is charged automatically at each renewal until you cancel.
• On the monthly plan, the minimum is 3 months; after that, cancel anytime by writing to info@prohubsystems.com. On the yearly plan, cancel the renewal anytime.
• If a payment does not go through, we email you the link to pay. If it is not paid within 7 days, your form pauses until it is paid, and then it works again exactly as it was, with your same link and QR.
• When you cancel, your form stops working at the end of the period you already paid: your clients will no longer be able to fill it out or send it.
• After you send your design, each change costs $29.99.
• On your card statement, the charge appears as SQ *BEAUTY BY ESTEPHANY.

• Es una suscripción con Square, al mes o al año: Pro $19.99 al mes o $199 al año; Premium $29.99 al mes o $299 al año. Se cobra sola en cada renovación hasta que la canceles.
• En el plan al mes, el mínimo es de 3 meses; después cancelas cuando quieras escribiéndonos a info@prohubsystems.com. En el plan al año, cancelas la renovación cuando quieras.
• Si un pago no pasa, te mandamos por correo el link para pagar. Si en 7 días no se paga, tu formulario se pausa hasta que se pague, y vuelve a funcionar tal cual estaba, con tu mismo link y tu mismo QR.
• Al cancelar, tu formulario deja de funcionar al terminar el periodo que ya pagaste: tus clientes ya no podrán llenarlo ni enviarlo.
• Después de enviar tu diseño, cada cambio cuesta $29.99.
• En tu tarjeta, el cargo aparece como SQ *BEAUTY BY ESTEPHANY.

8Your name and emailTu nombre y tu correo

When you type your name and email in the design studio, we use them to receive your design, create your form and write to you about it. We also write down the date you accepted these terms. We do not sell them.

Cuando escribes tu nombre y tu correo en el estudio de diseño, los usamos para recibir tu diseño, crear tu formulario y escribirte sobre él. También anotamos la fecha en que aceptaste estos términos. No los vendemos.

9If these terms are not followedSi no se cumplen estos términos

We may pause or end your license and take the legal action needed to protect our work.

Podemos pausar o terminar tu licencia y tomar las acciones legales necesarias para proteger nuestro trabajo.

10ChangesCambios

We may update these terms. The date at the top shows the version in effect.

11Governing lawLey aplicable

These terms are governed by the laws of the Commonwealth of Massachusetts and the federal laws of the United States.

12Your clients' health informationLos datos de salud de tus clientes

• Where it goes: the answers, photos and signature your clients send travel encrypted (https) from their phone to our sending system, a Google script in the Pro Hub Systems Google Workspace account. It emails them to the address you chose for consultations, in a PDF with the photos attached.
• Where it is not kept: not in a database, not in your panel, not on GitHub and not on your client's phone. The form does not save their answers on the device.
• The sent copy: Gmail keeps a copy of every email it sends. Our system moves that copy to the trash as soon as it is sent (or, at the latest, in its check every morning) and Google deletes it on its own after 30 days. We do not receive a copy of any consultation.
• Only if Google's daily email limit is reached: the consultation is saved in a private folder of our Google Drive so we can forward it to you the next day.
• If our sending system does not answer: your form uses FormSubmit (formsubmit.co), a form delivery service, as a backup to deliver it to your email.
• The thank you email: when they finish, your client receives a thank you email with your business name and contact details. That email does not include their answers.
• Who sees it: you, in your email. Once it arrives, how long you keep it and who else can read it depends on you and your email provider; you are responsible for protecting it under the laws that apply to your business.

• Por dónde viajan: las respuestas, las fotos y la firma que envían tus clientes viajan cifradas (https) desde su celular a nuestro sistema de envío, un script de Google en la cuenta de Google Workspace de Pro Hub Systems. Ese sistema te las manda al correo que elegiste para las consultas, en un PDF con las fotos adjuntas.
• Dónde no se guardan: ni en una base de datos, ni en tu panel, ni en GitHub, ni en el celular de tu cliente. El formulario no guarda sus respuestas en el aparato.
• La copia de envío: Gmail guarda una copia de cada correo que manda. Nuestro sistema manda esa copia a la papelera en cuanto sale (o, a más tardar, en su revisión de cada mañana) y Google la borra sola a los 30 días. A nosotros no nos llega copia de ninguna consulta.
• Solo si se llega al límite diario de correos de Google: la consulta se guarda en una carpeta privada de nuestro Google Drive para reenviártela al día siguiente.
• Si nuestro sistema de envío no responde: tu formulario usa como respaldo FormSubmit (formsubmit.co), un servicio de envío de formularios, para entregarla a tu correo.
• El correo de gracias: al terminar, tu cliente recibe un correo de gracias con el nombre de tu negocio y tus datos de contacto. Ese correo no incluye sus respuestas.
• Quién las ve: tú, en tu correo. Una vez que llegan, cuánto tiempo las guardas y quién más puede leerlas depende de ti y de tu proveedor de correo; tú eres responsable de cuidarlas según las leyes que apliquen a tu negocio.
